Welcome to Hits Bev Co, LLC (“Hits Bev Co,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, hitsbev.com (the “Site”), and your purchase or use of any products or services we offer (collectively, the “Services”). By visiting the Site or purchasing from us, you agree to these Terms and to our affiliated policies referenced here (Privacy, Shipping, Refund).

If you do not agree, please do not use the Site or the Services.

1. Using Our Site

  • Authority to contract. You represent that you’re legally able to enter into a binding agreement and that any information you provide is accurate and complete.

  • Account security. If you create an account, you are responsible for maintaining its confidentiality and for all activities under it. Notify us promptly of any unauthorized access.

2. Product & Ingredient Information (No Medical Use)

Our beverages feature functional ingredients (e.g., Lion’s Mane, Cordyceps, L-Theanine, vitamins, minerals, adaptogens, botanicals). Product descriptions, educational content, and customer communications are provided for general wellness and lifestyle information only.

  • No medical claims. The products and statements on this Site have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

  • Personal use. Products are for personal, lawful use only. Consult a qualified healthcare professional if you are pregnant, nursing, have a medical condition, or are taking medications.

3. Orders, Pricing & Availability

  • Offer & acceptance. Submitting an order is an offer to buy; we may accept, limit, or refuse any order (including after submission) due to availability, suspected fraud, or errors.

  • Pricing. Prices are shown in USD and may change without notice. Taxes and shipping are calculated at checkout as applicable.

  • Listing accuracy. We strive for accuracy but errors may occur. We may correct inaccuracies or cancel orders impacted by them.

4. Payment & Billing

By placing an order, you authorize us and our payment processors to charge your selected payment method for the full amount. You agree to provide current, complete, and accurate billing and shipping information and to promptly update it as needed.

5. Shipping, Delivery & Risk of Loss

Shipping timelines, methods, and fees are described in our Shipping Policy. Title and risk of loss pass to you upon our delivery to the carrier. Carrier delays, weather events, or operational disruptions may affect delivery timing and are outside our control.

6. Returns, Replacements & Refunds

Our approach to damaged, defective, or missing items—and eligibility for refunds—is outlined in our Refund Policy. Because our products are perishable, returns are generally not accepted.

7. Promotions & Offers

Any promotional codes, discounts, or limited-time offers are subject to posted terms, have no cash value, are non-transferable, and may be modified or discontinued at any time.

8. Intellectual Property

All content on the Site—logos, product names, copy, graphics, photographs, videos, and page designs—is owned by or licensed to Hits Bev Co and protected by intellectual-property laws. You may not copy, modify, distribute, reverse engineer, or create derivative works without our prior written consent.

9. User Content & Feedback

If you share reviews, photos, comments, or suggestions (“User Content”), you grant Hits Bev Co a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content in any media for marketing or operational purposes. You represent that you own or control the rights to your User Content and that it does not infringe any third-party rights or contain unlawful, misleading, or harmful material. We may moderate or remove content at our discretion.

10. Acceptable Use

You agree not to:

  • Use the Site for unlawful, harmful, fraudulent, or infringing activities;

  • Upload malware or attempt to interfere with security or performance;

  • Scrape, crawl, or harvest data without written permission;

  • Misrepresent your identity or affiliation;

  • Make or post medical claims or testimonials implying diagnosis, treatment, or cure.

We may suspend or terminate access for violations.

We rely on third-party providers (e.g., payment processors, analytics, fulfillment partners). THE SITE, SERVICES, AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, HITS BEV CO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HITS BEV CO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, OR DATA; OR BUSINESS INTERRUPTION—ARISING FROM OR RELATED TO YOUR USE OF THE SITE, THE SERVICES, OR OUR PRODUCTS—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE IN THE 90 DAYS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations; in those cases, the foregoing limits apply to the fullest extent permitted.

14. Indemnification

You agree to defend, indemnify, and hold harmless Hits Bev Co and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of these Terms; (b) your misuse of the Site or products; or (c) your infringement or misappropriation of any third-party rights.

15. Changes to the Services & Terms

We may modify or discontinue any part of the Services at any time. We may also update these Terms from time to time. Changes take effect upon posting to this page, with the “Last updated” date reflecting the most recent version. Your continued use of the Site after changes means you accept the updated Terms.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of state and federal courts located in Davidson County, Tennessee, for any dispute that is not subject to informal resolution.

17. Severability & Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision does not constitute a waiver of it.
